Agreement:

This agreement is generated and put in place for all my clients to let you know what each session means. This is also to ensure you that we will deliver the quality service while meeting your expectations. We would like to request you all to read the information carefully and contact us if you have any questions.

Terms:

In the following, there will be several terms that will be used. “The photographer” shall mean Sachin Shrestha as Sachin Shrestha Photography. “The clients” shall be those persons who are engaged in the session or are taking our service. “Studio” shall mean one of the location where your session might be taken place. “Session” shall mean your photographic time when your photographs are taken.

Copyright:

It is to agree upon that the photographer has the copyright of all the photographs on this website and is not allowed to resell, scan or reproduce these images without the permission from the photographer.

The originals and the edited images are the property of the photographer so therefore, the photographer as the right to use those images for any promotional or industry competitions. The use for the social media purpose will be discussed upon between the client and the photographer before publishing the images in the social media platform.

 

Session and Booking Fee:

A non-refundable booking and session fee of $200 AUD will confirm your booking with us. This shoot date and time will only be reserved after the booking and session fee is received. Failure to pay the deposit will result on the photographer to offer that time and date to the other clients. In any situation where you or your family members feel unwell, please call ahead to reschedule. Please be informed that the booking and session fee is non-refundable but is transferrable to any other future session.

 

Re-shoots and Attendance:

In some cases the reshoot are available but at the discretion of the photographer. It is not provided for regretful personal choices such as hair, outfit and makeup. To avoid such regretful situation, we provide the session guide to all of our clients to ensure and prepare you for the good photographic experience with us.

Please be mindful that our studio has limited space therefore only allow limited member from the family per session. Please communicate with the photographer prior the session to discuss the total number of attendees you are thinking in the session. It is to minimize the distraction as well to produce the successful session for the clients.

 

Storage and Maintenance:

The photographer will use the safe, pass code protected, online gallery to deliver your images. It is the client’s responsibility to backup and store your digital files in proper manner.

In regarding to the prints, albums and wall art, please handle them with an extreme care. Any damage appearing after the improper handling to the framing or prints will be the responsibility of the clients. Please be aware that as time goes by, due to the sunlight, the product may fade slightly or even may change color slightly regardless of being a high quality product.

Payment and Collection:

Payment in full of the remaining balance will be due on the session day. Additional products ordered or planning to order will be due on the time of ordering. Due to the order being customized for each client, your order will be a final sale and are non-refundable.

Please be aware that to develop your beautiful portraits there are lots of behind the scene involved. It may take about 2 to 4 weeks to deliver your final products. We will contact you once your order is ready and deliver it accordingly.

 

Editing:

The images will be edited and processed in the post production. However, the photographer will not offer any sorts of exaggerated editing such as adding another person in the image who was not available at the time of session, or even head swapping or change of eye, hair, and outfit colors.

Monitor Calibration:

Although the photographer’s monitor is calibrated and matched to the profile of our professional lab, it may not be case in your end. Clients may see a slight color difference between what they will view in their device and what is printed.

Also be aware that, the pictures being printed in any other places besides the pro lab may be slightly different due to the poor quality of the print and not the digital file provided by the photographer.

Force Majeure:

In the variety of unlikely events such as natural disaster, crime, flooding, pandemic, injury, or any sorts of event described as the legal term “Act of God”, the liability shall be limited to a full refund. Even though, we take an extreme care and safety of all the images in terms of storage and backing up, in case of above mentioned, the photographer shall not be liable for this.
